Conflicting markings.

I have appealed 2 parking tickets (for different vehicles but in the same bay)

One was because the ticket had run out by a few minutes, the other being for my permit running out (I didnt realise!)

I informally appealed both on the basis that the the parking area itself has conflicting markings and as such I believe cannot be enforced.

Despite being signed as permit or paid parking and having a white parking bay painted along the road there are double yellow lines which run through it (they are also broken at several points which makes the lines themselves invalid)

The reply I got from the council for both states the following -

Inote that you have stated that the bay markings in this area are not correct and although I appreciate your circumstances the vehicle in question was parked near to a sign that stated Mon – Sat from 8am – 10pm ‘permit E holders’ or pay at machine, display ticket. You have stated that an old yellow line is visible in the parking area and I'm sure you can appreciate that the council cannot be expected to redo all the reappearing lines within Medway immediately following general wear and tear. I advise that if the bay markings are clearly visible to a motorist, despite their minor imperfections or fading colour, then the line(s) would still remain enforceable. It is the repsonsibiltiy of the driver to ensure that all signage in the area I checked before leaving their vehicle unattanded.

Surely this is not right?

I want to now formally appeal but need some advice as to whether I am right that they cannot enforce a bay without correct markings.

    Right, what you need to do is :

    Register on pepipoo and start a new thread here

    Then you need to scan or photo you ticket - both sides ! and remove personal details from the ticket.

    Post photos of where you were parked and any signs, a google street view is also helpful but may be out of date.

    Pepipoo are the mutts nuts at getting council tickets cancelled either at formal reps or at adjudication if it gets that far.
