I know of loads of people who allow sons/daughters etc to use their mobility car.

A very close family member actually asked me if he could have the mobility car if I wasn't going to get one - I get the DLA allowance instead - and said he'd give me the monthly allowance for it!

    I said no!
  • My son is losing his car too. He is 11 and needs it to get him to school 6 miles away. He's not entitled to funded transport as we are not "deprived". The helpful suggestion was to stick him on a bus on his own. I'm hoping the reconsideration is heard fast otherwise we will be in real trouble getting him around.

As for family members using the car I have known people where the husband uses the motability car to go to work as it benefits the disabled person to have the income from the job. If you speak to them there is consideration made for that sort of thing. I drop my son off then might go to the shops (benefits him as he then gets fed) or the gym (try lifting an 11 year old when you do no exercise). I don't see that as cheating but I see a friend's husband using her car for his business as cheating - Motability said there was no issue if she was happy to be housebound while he provided for the family.
  • Unfortunately when motability customers ring DLA to ask about 'allowed usage' of the car they are often given mixed messages as to what is deemed acceptable and it is certainly open to misinterpretation. However the ruling on the use of the disabled road tax is much clearer and 'misuse' is implemented much more readily and can result in the removal of the vehicle. The named driver using it even as means to get to and from work even without any business use would be classed as inappropriate by the DVLA.(as you will all know You cannot have more than one tax disc per car either) Where as DLA will often allow this following the line of another income still benefiting the customer but definitely no business use at all. Good luck to you all who are having to go to the tribunal !
