Should my car insurance pay out?

I was involved in a car accident last year, to which I have always maintained that it was not my fault. However, the witnesses that saw the incident let me down, the police whom I blamed dug their heals in and refused to tell the truth, so my insurers solicitors contacted me and told me that even though they thought I was the innocent party in all this, they could do nothing to help me with the claim and it was a case of "game over".

A week ago, I get another letter from my solicitors telling me that the women who crashed into me told her insurers that she may have driven through a red light and that they now accept HALF of the fault and are willing to pay out for my car and my injury.

My question is this: I am full comp with Swiftcover and I was injured in the accident. Seeing as they say "no one was to blame"... should I be making a compensation claim for my injury from my insurers.

A friend told me that it's what I should have done from the start and that insurance companies are slippery and won't offer to pay you unless you ask.

Help please?

    Your insurer won't pay you any compensation for your injury, but you can pursue the third party insurer.

    Speak to your solicitor about this - if the blame is concluded as 50/50, then you should be able to get 50% of all your uninsured losses back from the third party, including 50% of any compensation for your injuries.

    Normal car insurance only includes a small Accident & Health subsection which pays out a token amount in the event of extreme injuries to its driver (eg loss of limb, blindness etc). Assuming your injuries are not this sever and you didnt buy any extended "personal injury" cover then your injury is a purely uninsured loss and can only be claimed from the TPI.

    On the basis of a 50/50 settlement you would receive 50% of the value of the claim from the TPI
