solicitor conflict of interest

This is regarding a residency order for a child, just wonding if it is a conflict of interest if the grandads nephews (nephew is a solicitor) business partner is acting for him? got to be some kind of conflict of interst since they own and work in the same practice.

    No. Not from a solicitors ethics point of view anyway. The relationship is far too distant, and the nephew personally doesn't stand to benefit from the outcome. But the business partner would not be allowed to discuss the case with the nephew due to confidentiality issues. Solicitors are good at chinese walls though.

    Solicitors have a number of duties, the most important being to act in the best interests of their client, if they cannot do so they must refuse/cease to act for the client.

    Your post is a little unclear though as to the relationships and how the grandad and/or nephew is involved (if at all).

    Are you saying that the grandad's nephew's business partner is working on behalf of the grandad, or on behalf of the opposing party? If he is working for the grandad, I can't see that there is a conflict of interest. And if he is working for the opposing party and that person isn't happy about it, then the answer would be to find a new solicitor.
