Tax Credits Overpayment HELP

I'm hoping someone can help/maybe explain the tax credit system a little better for me.

I have this week received my tax credit award notice and it states I have been overpaid by £3213.74.I have spoken to them and they are sending me a dispute form as I think this is incorrect.

The reason for the overpayment, they say, is because I haven't notified them of an increased income.

Household income for 2010-2011 was £21546.00. Combined income for 2011-2012 is £39442. I notified them in April 2011 that our income had increased to an estimated £32118. Then in June 2011, I completed my 2010-2011 income as £21546, and because of this they have taken that as the 2011-2012 income?!?! In July 2011, I had my second child and so, I rang to update my claim. At this time, they went through my income again and again I notified them of the income increase. When I have rang today to query it, they say they have details of the income provided in April 2011, then the renewal in June 2011, and then the next income details are April 2012.

They say they have no record of the income change made in July 2012, even though they do have a record of my phonecall for my second child?!?!

It doesn't really make any sense to me how they work it out. Any help would be appreciated

    Even if you told them and they didn't record it, they expect claimants to check the award notice and tell them if the income is wrong. So after you renewed in June 11, you would have received a new award notice for 11/12 with the 10/11 figure of 21k on it. They would have expected you to contact them to say it was wrong. Similarly in July 11, when you added the second child, you would have had another award notice.

    You can dispute, but if you have a look at COP 26 and the responsibilities test you will see why it will be hard to win.

  • Thank you for your reply. This is the part I don't understand. When they have sent the new notice for 11/12, why would I contact them to say the 21k is wrong, if that is the correct earnings for 10/11. I do always check the award notices when I get them and any errors, I contact them to change
