Someone damages a car causing £2000+ worth of damage - by kicking it (cars only worth £3000)

Cops ask for quotes as the "perp" is nicked bang to rights, make him pay, etc

Cops send the guy the HIGHEST quote (twice the lowest) and now say its too high, tough, they will just charge him with criminal damage

the car is in reality a write-off, NCB would be lost worth £1500, so will victim support pay up or is a CCJ the only way left?

  • Does the "perp" have the ability to repay? If not you may as well just use your insurance. You'd only lose 2 years no claims for a claim on your insurance - will this really cost you £1,500?

    its not for me, its for a young driver only passed test 3 years ago, so it will hit hard

    A £1500 hit through loss of NCB is a little over-dramatic.

    Many youngsters will be paying maybe £1k-£1.5k insurance, I doubt the loss of NCD would double it. Maybe a few hundred quid.

    his NCB would have to be rebuilt over THREE years, his year 1 was £2250, year3 was £950 so on that basis alone its £1300 - at least

    besides, why should he stand any loss?

    If the cops do the usual (SFA) im thinking about a CCJ, i think the guys a homeowner, if thats the case maybe a CO, or even a bankruptcy petition...

    loss of value (from £2700 paid to £1000 its now worth) is £1700
  • BTW arcon, if you think young drivers "only" pay £1500 do a few quotes!

    Police have no power to order anyone to pay compensation - only a court can do this, and if he is prosecuted, you need to make sure the CPS make an such an application at court (which is what the quotes are needed for). There is no Victim Support fund to pay for damage.

    Alternatively there is nothing to stop you taking out proceedings in the Small Claims Court process.

    Getting them to pay up, even when an order is made, is another matter - if they have no assets you are wasting your time. If he is a homeowner , then pursue any option you think may be worthwhile.
