Clouds Memory Foam - how can I claim?

Hi, I purchased a bed from Clouds Memory Foam after an offer on the Groupon site. After waiting 2.5 months for delivery I finally received it in December 2011. However, since then I have had nothing but quality issues and cannot, despite a numerouos emails and phonecalls, get anyone to respond to me. I have contacted trading standards and they say that they are not pursuing Clouds so I have to do it myself. I have written 2 letters (using the format they provided and sending recorded delivery - which I have tracked and got receipt of delivery signature of) but have received nothing back. I am loathed to take them to the small claims court as it is going to cost me as much, if not more, than the bed did in the first place. I am at my wits end. Being 6 months pregnant and sleeping on a faulty bed is unbearable. Can anyone suggest anything - particularly in relation to getting Trading Standards to get on board.

Thanks in advance

  • Why do you think you need trading standards? They rarely react to a single complaint.

Why do you think going to SCC is an issue? You can do it online at https://www.moneyclaim.gov.uk and it is quite cheap (£35 or so which you can add to your claim).

What is the problem with the mattress?

Small claims court is cheap. Unless the bed cost you under fifty quid, you'll find SCC is far cheaper, and your costs get added to the other side's liability

    What is faulty about it?
make the most of it, we are only here for the weekend.
and we will never, ever return.
  • I've been told to raise the claim through Money Claim online (which is £35.00) and then it was £40 for something else and then about £250 for something else. If I have been misquoted and someone knows that it is cheaper, all information would be gratefully received. I have never had to do this before......

The bed is faulty because the frame has come apart inside which means it slopes, and the matress is the lumpiest thing I have ever slept on - again slopes on each side.

Thanks for the comments so far
  • anymore help from anyone out there??

People give their time for free on here so will reply in due course.

Who said it would be £40 for what extra and £250 for something else extra? Can you elaborate on what this was supposedly for? I cant for the life of me think what it would be for.

Also how much did you pay for the bed?
When did you first make representations to the company?
    Are they still solvent?
Have you had ANY response from them?
If so have they offered to remedy the situation?

I can only suggest you look at the Money Claim Online website.

In there you will find details of all the fees.

How did you pay for the bed?
If by credit card, you might like to read MSE's Section 75 Refunds article.
