refused credit then item arrived

Hi.

1st poster...

Only to put it briefly.

I ordered some jewellery for my wife as it offered good finance terms and I wasn't in a position to pay that amount out in cash. So I proceeded with the application (which on every page had approved) then finally... we request more information... please call us.

I called and they asked me to provide my most recent playslip. I notified them I had been off work and my payslip would only show a small amount of holiday pay and that I would need to contact work to get it sent out. The representative said they would need to see it regardless and we ended the call.

Within 5 minutes I received an email stating - Declined. I thought well that's that and forgot about it. About a week later i wanted to delete the email account I had used, so I deleted all of the contents and closed the account.

Roll on last week, postman arrived with a box. I took it in and had no idea what it was. The jewellery had arrived. I showed it to my wife but didn't explain the circumstances. On Friday she flew out to have he yearly visit home to see her family. I thought I'll leave the item there until I get some sort of paperwork through to see what the situation is and why it's been sent.

Today I went to look at the invoice I got with the item (not requesting any payment) and the box is gone. I called my wife and she said that she's wearing it and it looks great!

I'm panicing now. I don't have the cash to pay for it. I'm still presuming I've been rejected for the credit and i don't know what to do. If the company ask for it what can I do? Can I make an arrangement with them to pay as I've had nothing from either party in the post (except the item). There is no DD on my bank account and no deposit taken from my card eventhough it said that the deposit would be taken immediately.

It's like a scene from only fools and horses. Maybe if I hadn't deleted the email account something would have been sent there to give me an indication of the situation.

Where do I stand? Have I ever had a contractual obligation with the retailer as my dealing were with a finance company which now seems to have ceased since the refused credit email.

Hopefully something will arrive by post soon. I don't what will happen if I call the retailer and they ask me to return it and I say I haven't got it. Last thing I want is any financial negativity over an item i didn't expect to receive :(

    I have to say, this has all the makings of a classic trolling thread. Various aspects to your story simply don't add up. You deleting the email account just after using it to order something, then your wife taking it away without telling you...

    I agree, seems like it could be a trolling thread, so many things a person with an ounce common sense would have done.

    Has your wife gone forever?
    Can you not just wait until she is back and then return the jewellery?
    Or call the company and make and arrangement and if that is to return the jewellery then send it back when your wife returns?
    Can your wife not send it back from wherever she is?
    Why did you not tell her that you hadn't paid for it and they were not for her?

    I don't understand what the issue is, you still have the jewellery, just because it has been taken on a trip means it should be returnable when it comes back. Or you can just make an arrangement to pay. Just call the company and deal with it.

    Edit: I have just seen the poll, definitely a troll thread. 3 of your options are about either trying to scam the items from the company or bury your head in the sand.

    Why would you delete the email account? It's clearly active if you used it for the purchase.

    Either way, one of the the following two scenarios are valid
    1 - you own the goods and the balance is owed to them, they can pursue you
    2 - you do not own the goods, they was sent in error and you have a duty of care with the goods

    (Not that is matters since this thread is clearly not real)

    I only posted for a bit of advice and not for personal attack. I'm surprised that people with an once of financial knowledge can rely on assumptions and label it a "trolling" thread (whatever that is).

    Anyhow back to the "troll" and you can believe me or not as everyone one is entitled to their own opinion (not sure if that includes defamation of character)

    Ok, almost there.... BTW there is a longer version available on request and the poll has been there since day 1. Give your specks a polish young chap.

    Firstly, I had been wanting to delete the email account for sometime. People in the real world do this especially as there was nothing of importance attached and loads of spam (not the tinned variety) in it.

    Secondly if you knew my wife, you'd understand what she is capable of. If I told her the situation now, I wouldn't be surprised if she "just forgot" to bring it back with her. This normally happens with LV bags so she can get to Selfridges to buy another.

    Ofcourse my wife hasn't gone forever! Someone with an ounce of common sense would assume that. As mentioned, if I tell her it needs to back, it could just "disappear" and anyhow their postal system is corrupt. How will be returning an item which is now used and safe to assume, secondhand.

    Finally, i'm just checking now to see if I have any legal standing against "deluge of waffle".

    The situation is real. I'm sorry if I've allowed your over-active imagination to create havoc amongst that grey matter.

    I'll leave it for the moment.

    2. try a little HONESTY with your wife - the credit failed so you have to give the jewellery back.
    Should've = Should HAVE (not 'of')
    Would've = Would HAVE (not 'of')

    No, I am not perfect, but yes I do judge people on their use of basic English language. If you didn't know the above, then learn it! (If English is your second language, then you are forgiven!)
