help with gym membership

hello all, any help would be much appreciated...
I've recently joined a gym that uses an accounts management company to deal with the memberships and the payments side of things. The company is called ashbourne management.
On signing up online to the membership they over-charged me by £27.50. I promptly contacted both the management company and gym and the whole issue was apparently resolved as they said i would be reimbursed the money. This was 2 weeks ago and i've not yet received a penny even though they say they had sent a cheque.
Now im not about to rush into a full on court battle but i would like to know what my rights are should this situation escalate?
I've just now sent them a secondary email asking them to confirm whether they sent the cheque via recorded delivery and if so had the cheque been cashed yet.
What i would like to know is that due to the fact ive been over charged, would this be a breach of my contract?
many thanks,
tom

Not a major breach of of contract, not enough of a reason to get out of it if that is what you are thinking.
How did you pay? DD / CC? In either case of these contact the bank to have the payment reversed.Thinking critically since 1996....0 -
can it not be applied to next months fee?0
