Interesting point about taking it on holiday - but it could be ok?
The problem is after you've had it more than a few weeks, everything is subject to interpretation and the guidance comes from the outcome of cases that have gone to court.
Even though it may be grey area, if you particularly want a refund rather than replacement or repair, try rejecting it and claiming a refund, and see what happens. Nothing ventured - nothing gained.
If he says no and it looks like your case is uncertain, you may have to accept refund/repair (assuming you don't want to go to court).
