Currys Oven

My elderly (84 years old) grandmother purchased an all in one oven and hob from Currys on 2nd August. AEG Model 49002VMN (along with a 5 year extended warranty, but thats a different and equally annoying story).

It has a very fiddly method of operation and in my opinion not suitable for the purchaser. The buttons are very hard to see, and very arkward for someone as advanced in years.

I have spent the best part of 2 hours trying to explain the operation to her, but she cannot grasp it.

I have contacted Currys and they are hiding behind their returns policy, it has been used and cannot be returned.

I have tried to look at the sale of goods act with regard to suitability of the end user, but am struggling to find anything. I believe Currys been negligent selling such a product to an elderly person.

Can someone help me and my daft old Gran??

How exactly do you prove that Currys have been negligent in selling such a product?

Based on the way the above is written you were not present when your gran was in the shop - so how exactly you would prove this I really don't know.

You should be looking for missold in SOGA if that's how you feel, as this would, if you deem it so, be miss selling, not suitability.
  • I have got a picture of the oven, but as a newbie I'm not allowed to post a link

I was not present, nor was anyone else.

I have searched the sale of goods act again and cannot find a mention on mis-selling

2D, E and F is what you are looking for - specifically the process of fit for purpose:

    http://www.legislation.gov.uk/ukpga/1979/54

The problem you have is proving that your Gran asked for a specific good, with specific conditions and that Curry's intentionally ignored that request and sold her a product in contradiction to the request.

Proving that will be quite a feat based on the information you've supplied so far. Unfortunately I cannot see how you will be able to realistically prove this - unless you can obtain a recording of the process of sale...

Was the cooker not on display in the store?

You think the sales person should have said "I think you're too old to use this oven, you'll need a simpler one..."?! And you and your grandmother would have been happy with a comment like that?

Did you grandmother not choose the oven herself? Or see it before purchasing? It is not for the salesperson to question the age/ability/intelligence of the user!
