Sounds very much like the British Gas v Ferguson case where mrs F was pursued by BG for debts she didnt owe them, so she took them to court for harassment - which is what I suggest you should do.
Put both EDF and Roxburghe under notice of Harassment, tell them to cease harassing you for debts that are non existent. If they continue their harassment then sue the pants off them.You may click thanks if you found my advice useful0 -
I was all lined up to do this, I even got the postcode of the MacDonald's nearest their offices, but it turns out Roxburghe are not the villians in this piece.
I actually received a letter from Roxburghe proving they weren't just trying it on and as far as they are concerned the debt they are chasing is genuine - the mistake is on behalf of EDF who for some reason decided I should pay the electricity bill for a flat that is in the same block as one I do own. EDF even took £951 out of my account last November without warning. After a lot of grief I got the money back from EDF and they admitted fault but they didn't close the account properly. Money was still owed and they passed it to their debt department who in turn passed it on to Roxburghe. At no time since November has EDF contacted me.
Furious with EDF and going to complain - not sure what good it will do.
Look up 'Ferguson -v- British Gas', you don't need a solicitor or anything and can claim back your Small Claim fee plus interest at 8% on top of the amount you claim. Get past 'go' and collect several hundred pounds compensation from EDF - you can even just do it online using MoneyClaimOnline as long as you send them a Letter Before Action first (Google for examples).PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

Taking someone to court using MCOL is - to use an inappropriate but accurate analogy - criminally easy. I've done it with Mint, the old credit card firm and TalkTalk. Both settled out of court for what they owed me plus the £35 cost of issuing the claim.The acquisition of wealth is no longer the driving force in my life.

Echo that, it's a doddle, I claimed all sorts of things from an hotel that welched on a room reservation, leaving me scrabbling around the area when I arrived trying to find another hotel that wasn't full.
Thy tried to defend it initially, but eventually they folded and paid up before it got to court.Je suis Charlie.0
