I'm confused with ESA

my claim for ESA was closed because of a missed appointment, I was told to start a new claim as appealing would take a year and I wouldn't get any benifts untill the appeal was heard, so I started a new ESA claim but now have to wait for a medical appointment and am not receiving any benefits until I pass that appointment.and have been told the medical may be many weeks away.

So my question is as it has now been more than 1 month since my first claim was closed can I still appeal that decision and would I receive any benefits whilst it is waiting to be heard?

    You can submit a late appeal if you can give good reason why you are doing so outside of the normal month, however, you will still not be paid the ESA assessment rate until you have attended a medical or six months have passed since the decision that you were technically fit for work (because of the original missed medical)

    Agree with Captain Scarlet - with the small issue that if your condition has significantly worsened or a new condition has developed, then you can make a fresh claim, without the missed medical affecting payment.

    I have already handed my form in, how would I prove my condition has worsened? would I need a letter from the doctor.

    A letter from a doctor would be useful, yes.
    I am unsure about the procedure when a claimant says their condition has worsened, without evidence.

    There has to be have been a significant deterioration (significant is not defined), supported by evidence that is later than that previously used.
