trustee on a 'life' plan

my partner recently rec'd a letter from a well known life assurance company stating that 'as he may be aware' (totally wasnt aware!) your mother has appointed you as a trustee of her adaptable life plan. please read the enclosed booklet.

erm, his mum has said absolutely nothing to us about this.he hasn't signed anything. i know she has recently bought some property but her houses are mortgaged up to the hills and shes not great with money so we are worried that we'll be left with her debt if my partner is a trustee.
also shouldn't he have signed something? dont even know what he's a trustee of!

    No, the trustee's do not need to sign. The insured must when creating the trust and normally the signature must be witnessed but the witness doesnt have to be one of the trustees.

    On the basis that the trust is simply for receiving the proceeds of the life insurance there is no acceptance of any liabilities for the debts that she may happen to have by being one of the trustees.

    A trustee who has not consented to being so can simply refuse to accept the appointment. If they do not wish to do so, I suggest writing to the insurer and informing them accordingly.

    Also as a trustee your agreeing to look after the policy for whoever the beneficiary is.

    Your not liable for anything your just there to ensure any payout goes to whoever his mother wants it to go to. your not liable for the debts.
