What legal action was you thinking of taking against a company trading from another country? furthermore not even a EU country so your rights are a little limited. They are also offering a full refund so I don't think your card supplier would be that interested.

I think your options are keep the dresses which now fit anyway or send the items back to at least receive some of your money back.

If the company is based in India then you need to seek information on your rights on online purchasing in India as your rights are likely not the same if they were based in the UK.

If they were based in the UK you'd waive all your rights by having the dresses altered yourself as this would not be an action consistent with wanting to send them back. You've also worn them so they are no longer new which they need to be under DSR (you can try them but wearing them to a wedding does not constitute inspection as it would do in a shop). Finally, if it were under DSR they could also charge you for return postage but would have to refund the full purchase price including initial delivery.

I think you'll be very, very lucky to get anything here.
