Hiya - Just a quick question...
Large company now nearing the end of its 90 day consultation period...around 600 people are being made redundant. I have found out that the temporary staff were not at risk..is this legal? As they get to keep their job, yet someone on the same team, doing the same thing but on a permanent contract is losing theirs?

What have your reps been doing for 90 days?
ask for the pooling and selection criteria.0 -
By temporary staff, do you mean agency staff? Because the employer might argue that they are more flexible and cheaper and that therefore keeping them meets business need better.0

sorry yes we were aware of the 90 day consultation period right from the beginning, but it has only just come to light that 'agency' staff are not at risk..
Surely they cost the company more money though as they have to pay the wages of the staff aswell as a fee to the temp agency?

Agency staff can never be technically "at risk". It does not mean they will not lose their jobs with your employer. Have you learned they will in fact be retained without pause or are you assuming that because they are not "at risk" that they will stay?0 -
some of the line managers\bosses have said that they 'may' not be here long, but with this particularly company anything is possible...And I can easily see that in 3 months time they will still be here0

They aren't included as they are not eligible for redundancy (ie they end their contract and pay them nothing). You get 90 days plus your notice plus your redundancy.
They get nothing at all - so no need to consult with them.
But yes many companies keep on agency staff and get rid of permanent. they are cheaper for lots of companies and more felxible to diverse and fluctuating business.0 -

That was my point you should have been aware of this much earlier and the reasons why the business might retain the agency staff.
Your reps have let you down.
They should be arguing a case to keep some people on longer, might mean phased redundancies but people get to stay abit longer might clock up another years service business might improve so they end up keeping their jobs etc.0
