CCJ for Council Tax, even though on Benefits.

  • My bad if i thought it was a CCJ, as the first letter we got was ordering us to court so i just assumed. The second was the liability letter.

    Going to get on it tomorrow, and hope it gets sorted out :(

  • That's incorrect - a person on JSA may not have to pay council tax if they are entitled to and awarded council tax benefit but JSA doesn't automatically mean you don't pay council tax.



    I know i don't have to pay any as i was on the same JSA/HB/CT last year before i moved, so im 100% once they've delt with the claim, they will pay all said CT off.

    The point being that you probably won't have any council tax to pay once CTB has been awarded but until that point the law is clear that you have council tax to pay irrespective of whether you have a pending claim or entitlement to CTB.

    Until CTB is actually awarded it doesn't exist as far as payment of council tax is concerned.
    I no longer work in Council Tax Recovery but instead work as a specialist Council Tax paralegal assisting landlords and Council Tax payers with council tax disputes and valuation tribunals. My views are my own reading of the law and you should always check with the local authority in question.

    You are correct i don't disagree with you at all. :)

    At the end of the day, i've put a claim in because i can't afford to pay council tax, hopefully soon i'll bag myself a job and i won't have to deal with any of the claims.

    I'm going to CAB tomorrow, bright and early to see what they say on the matter.

  • Went to CBA today, they rang on my behalf explaining my situation.

    They basically said the average wait for the papers to be processed is 15 weeks (we've been waiting 12 weeks so far) so we are hoping things will be running soon.

    They also said they understand why i've not paid my CT and that she will send an email/letter asking for the CT to be rewound 3 months so i#m not in any of this trouble with the courts, as they know once my claim has gone through all outstanding CT will be paid off.

    She said it's not 100% they will rewind it 3 months, but it's likely due to the circumstances and she also said it is 1005 their fault.

    Here's to hoping it's sortied soon.
