credit account without me knowing

Just looking for some advise, I placed an order a few months ago for some clothing from H&M which i paid for by card. Items came all was fine, I had assumed the money had been taken from my account but as I have been in and out of hospital didn't check.

Yesterday I logged into H&M on-line and its saying i owe them £xx.xx. I emailed to query this and they told me they were unable to charge my card at the time so instead opened me a credit account.

They have charged me late fees as payments have not been made on the account. I told them I didn't know I owed any money so could not have made payments and told them if they took of the late fees i would pay the original amount owed. They refused to do so and have told me they have sent several statements. I have not received any of these.

Is there anything I can do? After all I did not ask them to open me an account.

    Does it say in their T&Cs about a credit account being created? Is/was there a checkbox to check/clear regarding this?

    AFAIK they cannot arbitrarily create a credit account for someone without their agreement.

    HOW did they send statements? Post or email? Can they PROVE such statements were sent?

    For a start, why not pay them the amount you consider you owe them and let them chase you for anything else?

    Why should their credit ratig take ahammering fro non payment of what is outstanding, which it probably has already?
  • On the "Checkout Info" page it gives four payment options - Payment slip in parcel, Monthly Invoice, Monthly Instalments, Card. Are you sure you didn't select one of the first three?

    I know I selected card payment, entered card details etc and have an email confirmation to prove this.

    Well I could but then I will still receive bills/interest/late payment fees for the charges they have applied and once I make a payment I am guessing its going to be even more unlikely they will remove the charges.

    I can not see anything in there T&C's about creating a credit account if card payments can not be taken.

    They have told me they sent the statements via post.

    Not that I can think of had the money in the bank, there was no invoice just a list of items ordered and a returns slips. (as far as I remember anyway, I have it somewhere so will dig it out and double check)

    Did you pay them as soon as you found out it didn't come out of your card?
