That is important and something they should be taking into account.
If they truly believe that you are trying to pull a fast one - and people do, unfortunately - they will probably let you take it to court on the basis that most people are not stupid enough to lie under oath when they have no way of knowing if they could be caught out.

Anyone could use the ploy that they received the goods, call up straight away saying they're worn, then wear them and send them back. Think you might have to keep them, why not try to sell them on Ebay if you don't want to wear them, at least you'll get some money back.0

Fortunately the courts don't tend to make an assumption that people are lying in civil cases.
You merely have to demonstrate that, on the balance of probabilities, the goods were damaged when they arrived.
On the other hand, to defend the case, Very would have to convince the judge that you phoned up to report damage on the off chance that you would damage the boots during the next week.

I can't sell them on ebay as they were sent back to very. And if i could who would want to buy a pair of ugh boots that are ripped.
I paid £190 for boots that were damaged. According to trading standards they have to prove they were checked when they left there warehouse and very can't.0 -
You are entitled to return mail order goods to the retailer under the Distance Selling Regulations, fo a full refund. As you let them know within minutes of the goods arriving that there was fault, I cannot see how they can get out of refunding you. You could also do a Visa Chargeback if you paid by debit card or a Section 75 if by credit card.0

Yes i reported it before going away and i was leaving early in the morning couldn't post them till i got back.

I bet you are calling them on the 0844 number. Don't! Enquiries can be reached on 08081010021 (Hold music then straight to advisor.
Ring them between 9-5 tomorrow, Go through DPA. When they say "How can I help" Ask (you must say either of these by name otherwise it won't work)
"Put me through to Customer Excellence, I am unwilling to put any complaints in writing"
If they refuse, Ask for Anthony Baldwins office.
Either way you will get through to Customer Excellence, This is the only department in SDG that will help you. Explain the situation to them. Don't add any emotion, stick to facts.
If you speak to RCU (Basically returns centre) or enquries, You'll be told to write in to RCU (Elizabeth Lofthouse) or to general CS. Waste of time. RCU have decided (and put notes on your account) you are guilty. No one but Customer Excellence can help you.
Tell customer excellence that you rang in, Connect (system they use) will tell them if you did call in and speak to an operator.
