Town and country parking fine

Just got back off a few days away and my hubbie said that he has paid a £40 parking fine from town and country for parking over the allowed time. He said he paid it as if he had waited for me it would have doubled!!!! I am mad with him as said he shouldn't have paid it as usually on here advice to ignore as can't take you to court. Feel like writing a stinking letter to them asking for it back. What do you think my chances are?!?

    Next to none.
They've got your money, why would they give it back without a fight?

Your husband would have to sue them for £39 or whatever since he paid it. You can't do much but tell him he's an idiot I'm afraid.

If this was at a retail store, you might want to write to them and tell them you will not be returning.

Chances of recovery = in between slim and none. And Slim just left the building.

But the good news is, I've forwarded your details to MSE admin, and your husband will shortly be receiving one of our special coffee mugs, with the inscription "Most Gullible Mug 2012"

I have been providing assistance, including Lay Representation at Court hearings (current score: won 57, lost 14), to defendants in parking cases for over 5 years. I have an LLB (Hons) degree, and have a Graduate Diploma in Civil Litigation from CILEx. However, any advice given on these forums by me is NOT formal legal advice, and I accept no liability for its accuracy.

Chances of getting your money back - close to zero.
Chances of expecting something extra-special at your next birthday/Christmas/anniversary - very high, I would hope :kisses2:.
  • Thought so!!!!! The next birthday s going to cost him a lot more than he expected!!!! So far he is doing the ironing, cooking, cleaning dog walking etc etc. His logic was saved you money as it was going up!!!! My logic they are not gonna take me to court for £40 so that's their money towards an Xmas party!!!!!!
In his defence (small here) think I would have done the same years ago but now I know as long as you get letters they have as much chance of getting the money from me as my hubbie is at getting a refund!!!!! But knowing my luck I would be the o e they take to court and win!!!!

To get your money back is actually very easy. Next time you park there, don't buy a ticket and keep on doing that until you have covered your losses

    Only if the law changes.

There are now recent landmark court cases, VCS Parking Control vs. Ronald Ibbotson, S!!!!horpe, 2012, HM Revenue & Customs vs. VCS Parking Control, Lower Tax Tribunal, 2012 and VCS Parking Control vs. HM Revenue & Customs (Appeal), Upper Tax Tribunal, 2012. In these cases, the judges ruled that only the car park owner can charge for parking and take drivers to court. The Upper Tax Tribunal is equivalent to the High Court, and therefore its judgements set legal precedents.

Revenge (unlike porridge) is a dish best eaten cold.

PS. And this refers to both Mr. OP and TCP. :)
The acquisition of wealth is no longer the driving force in my life. :)

You could also insist that he spends at least 10 hours exploring this forum. Just in case he still thinks that paying up promptly is saving him some money.
I can afford anything that I want.
Just so long as I don't want much.
