PPI defence

I am making a PPI claim against a well known credit card company and their defence is that I ticked the box on the form when applying. Before I go to the ombudsman do I have a case that at the time I was not aware that other methods of insurance where made aware to me?

  • You ticked the box meaning you read and understood - so no misselling?

I dont know if that is something used to decline ppi - have no experience of it

Sounds like Capital One. Ticking the box is a good defence. You can't claim that you didn't want the PPI when you requested it. It all depends on whether the ombudsman thinks that ticking a box is adequate. Go ahead with the ombudsman: The worst that can happen is that they will say that you don't have a leg to stand on.

But in order to appeal to the Ombudsman you must first have been through the full complaints procedure of the company first. They will have this in writing somewhere or they must supply the details of it in writing on request.

The FOS have a backlog so you could be waiting years just for them to look at your case.
