hi
I was wondering the course of action to take with these letters that have started arriving at my door from a Mk rapid recoveries firm for total of £58 which i have researched on the internet work for recovering catalogue company's unpaid accounts. I must of took the wrong course of advice when reading how to approach the firm as having rang them up to inquire what the hell its all about but refusing to tell then who I was or acknowledged the debt they refused to talk to me about it but to say they are passing it onto a collector. I told them I was seeking legal advice due to harassment as I read seeking money from me with no evidence of what the hell its for is not legal.

I have never had nor used a catalogue in my life but once in 1998 for a pair of trainers that I never received this was communicated to littlewoods at the time due the fact in my estate gypsies where following the white arrow vans an lifting parcels been left. My neighbour saw the parcel been left behind my bin an 5 mins later a guy taking it away. I only come home to a note stating parcel been left behind bin. This was communicated to littlewoods at the time and was told another order was to be dispatched to me which I expressed not to leave outside my premisses this never happened no parcel or card of delivery arrived. I surmised that was the end of that and have never heard from them in the 13 yrs since. I only opted for catalogue due to separating and just having got a house was strapped for cash.

Iam aware of the prove it letter and statue of somthing law where a debt is no longer valid if a period of 6 yrs passes an no communication has be given about the debt. Mk rapid recoveries have stated pay now an we only want £28 of the £58 only if I pay within two weeks but I is having nothing to do with any of it i simply did not get the order if indeed this is the reason for these letters.

Can anyone please advise on my 1st call of action to resolve this issue.

Many thanks for your help in advance.

Letter in this link would probably be suitable.

Sounds like it's either not yours, or statute barred. Either way, MK can "take a hike".

Also when sending the no knowlege/ statute barred letter do I actually sign it with my name.

Sorry to hijack but it seemed like an appropriate place.

I had a letter sent to my house from Shop Direct Finance Company saying they had passed a debt on to MKDP LLP which has appointed MK Rapid Recoveries.

The address on the letter is exactly as mine is, but I don't recognise the name of the person they sent it to, and we've been here for six years, and it's not even the name of the person who lived here before us!

I've tried to ring them to tell them to take a hike, but it either rings indefinitely, or they answer and then put it down - they're obviously much more used to making intimidating outbound calls.

I'm thinking I should just chuck it in the bin, but can they send the bailiffs round or tarnish my credit file somehow if I don't contact them?

Bailiffs can only be appointed if there is a defaulted ccj.

They shouldn't put a mark on your credit file. As it's a different name, you are safe - credit files are not linked through addresses these days.

I would return it (and subsequent letters) marked 'not known at this address'

I wouldn't ring - certainly not without blocking my number.
