Time limit on rejoining an employer after redundancy.

Hi,
I and other's got made redundant from BT 12 years ago and we joined the company which took over our work. Now 12 years on BT has decided to take that work back in house with us being Tuped over.
A colleague has now mentioned that in our leaver's pack from BT it states that we cannot be re-employed by them. Just wondered if anyone else has heard of this and is there a time limit, Or have they rejoined a previous employer.

Hello, it is completely irrelevant what it said in your leavers pack.
Why? Because you are protected by TUPE - that is the whole point of the legislation. It protects your employment in this sort of case. So in law the new employer steps into the shoes of the old employer, and all your years of service with the old employer also count with the new employer.I'm a retired employment solicitor. when i was made redundant in may i took voluntary, i was told if i was re employed by the company within 1 year then i may have to repay some or all the redundancy package. Compulsory didn't have this restriction.0

It was voluntary all those years ago, but i didn't keep all the paperwork. My colleague didn't mention a time period.
Our management are having road-shows this week but from what i have heard there is very little information being provided by BT.
I suppose it's a case of wait and see.0 -
The only instances of this I have heard have had a period of 1-2 years, so after 12 I think should be fine.I have had many Light Bulb Moments. The trouble is someone keeps turning the bulb off
