Public holidays with P/T job

My partner is currently working full time but will be reducing his hours to 26 P/W from Oct with the same company. Now we accept that his annual leave will be reduced pro rata, but his company are also reducing his public holidays (ie Christmas) entiltlement. Would this be correct as I thought that he should be allowed all public holidays especially as Christmas this year falls on his working days. I'd apprecaite any advise from other part timers.

It would be unfair for a part-timer to have more holiday pro rata than a full-time person. (Not actually unlawful but nevertheless not fair.)
In fact the company should combine public holidays and other holiday entitlement and pro rate the lot together.
What holiday entitlement does he have as a full-time worker and how many hours does he work currently?0 -
When I have worked part time the bank hols and annual leave are all pro rata
for example A/L FT in my job would be 30 days, the statutory and public holidays would be 10 so a total of 40 - if you work half time then you get 20 days. Have to take some of these if not working Xmas / boxing day / new years day etc .
As it is I always work Xmas day / easter day and public holidays so shakes down differently0 -
OP as long as he gets 5.6 weeks leave then the employer is doing nothing wrong (assuning they dont give enhanced hols), they can dictate when he takes these days and can if they wish make him work on bank holidays if his shift falls on that day.
eg, if he works a 5 day week he should get 28 days minimum
if he works a 4 day week he should get 22.4 days minimum.Be Alert..........Britain needs lerts.0 -
He will be working a total of 26 hrs p/w made up over 3 days of 2x9 hrs and 1x8. His company work his holidays in hours instead of days. It would appear (from these replies) that public holidays should also be pro rata to the hours worked, so perhaps his company are working it out correctly. What are the answers to questions in post #3?
He's not losing public holidays if he is not required to work them.
If they don't fall on a normal working day, he still has the day off.
If they fall on a normal working day, he still gets them off (unless the company does actually work on bank holidays and require him to attend). However if that would mean he doesn't have enough holiday entitlement from the pro rata allowance for such holidays he would have the time deducted from his "normal" holiday entitlement.
As I said in post #3, it would be unfair (on the full-time workers) if a part-timer received more holiday on a pro rata basis than they did.0 -

OK - he is currently working a 35 hour week and he gets 189 hours holiday per year. (Public holidays are not included in this total and he currently gets all puiblic holidays as paid leave). When he goes p/t , he'll be doing 26 hours over 3 days. I'm finding it difficult to work out the public holidays portion. As far as the annual leave is concerend, I calculated this as 189*26/35. Would this be correct?0

This is what I'm finding difficult. When you say 16.8 days off, this becomes very difficcult to equate it to my partner's working days, as his days are different hours - 2x9 and 1x8, this is why his company use holiday hours instead of days because when he has a day off this could be a 9 hour day or an 8 hour day. He has the same thing now - if he wants a Mon off, he has to book 9 hours, but if he weants a Fri, he has to book an 8 hours. He is currently getting more than the statutory minimum entitlement.
The minimum entitlement (5.6 weeks for someone working 5 or more days a week) equates to 12.07% of worked hours. So
35 * 0.1207 x (52 - 5.6) = 192.64 hours. The public holidays (8 days in a normal year) more than compensate for the 3.64 hours.
You are correct in working out the "ordinary" leave pro rata.
When working 35 hours a week, were the worked days of equal length? If so, take 8 days, multiply by the hours per day and then apply the same 26/35 pro rating fraction.0
