Income based JSA cut, living on £39pw

My Income based JSA has been cut from £71 to £39.38, as I am in receipt of Industrial Injuries Disablement Benefit of £31.62. This has actually been paid into my ex wife's bank since we split in 2009, as informal child support,(aged 17 in 6th form for another year) so I never see it.
I understand why it's been taken into account, but this seems at odds with the decision letter which states that the amount that the law says I need to live on is £71. They are not aware that I never see the £31.62. If they were, would it make any difference? I hesitate to reclaim it from my ex. Do I have any options beyond virtual starvation?

The Industrial Injuries Disablement should be paid to you hence your JSA being reduced. Can you change the bank account with the payee, as you are on benefits you would be assessed at £5 per week for maintenance.
It is nice that you want to pay more however if you are not able to pay your own bills this is probably not something you can afford to do at this point in time0 -
The DWP are paying the £71 to which you are entitled. You need to stop the money being paid to your ex wife.0

Agree with the above posters. It is admirable that you want to pay a decent amount of child support but, in reality, you don't have it to give.DMP Mutual Support Thread member 244

Speaking in general, for many benefits you can't simply give away income or capital, and have it not counted.
Be aware that they may (assuming JSA has been in payment for a while) require the repayment of the amount overpaid.
If this has been from 2009 to now, this could be a substantial sum.
This decision to recover may be appealable.0 -
I've not long signed on, so that's ok. Looks like I'm going to have to bite the bullet and transfer payment to my account.
