Can I open “item not received” and “item not as described” disputes?

If I don’t receive an ebay purchase, I can open an “item not received” dispute.

If I then receive the item, but it is “significantly not as described”, can I then open another dispute?

If not, can I keep the original dispute open but amend the complaint appropriately?

  • you can only open one dispute which can not be changed or reopened once closed :)

    If so, then here is a good scam.

    List a cheap copy item as an expensive original.

    Sell it and accept Paypal only.

    Don’t despatch it until buyer opens a dispute.

    Then despatch it via a PayPal approved method.

    The buyer is then stuffed as he can’t complain.

    What am I missing? :confused: Ebay and Paypal must have considered this scenario.
  • as far as i know when a buyer escelates a claim, the seller would have to produce a tracking number ,for which the item would have to of been delivered. so they couldnt wait as when they send it,it would show as not being recieved. if that makes sense :)

    if buyer opens not received dispute and you dont have proof of delivery they will win..

    if you dont send item within 7 days you lose any seller protection...

    As pennylane99 pointed out the seller must ship within seven days of PayPal payment or they lose whatever Seller Protection they may have. However, it's true you can't usually open more than one dispute on a PayPal transaction. When you open a dispute, you have to choose either: 'non-delivery' or 'significantly not as described' (SNAD). However PayPal is not the only protection consumers have...

    If the buyer paid using a credit card, they can file a SNAD dispute and get a full refund via credit card chargeback. They can also lodge complaints with the appropriate authorities, and notify the trademark owner that the seller is supplying fakes. Many well known brands have their own investigators whose job it is to track down the source of fakes and prosecute them; they often offer a reward for information that leads to a prosecution :-)

    They know of it and close the accounts of those caught doing it. PayPal will routinely ask sellers to provide receipts and paperwork to prove their items are genuine, and suspend accounts that don't comply within a short time frame. It's often a topic in this forum...
