Employer leased car and PCN's problems!!

    EHBA- you are exactly right. When I complained about this to my employer they gave me the regular song and dance-this is contractual, nothing you can do, blah, blah. I told them I need to appeal but I also know that the appeal will go nowhere because the council clearly states on the PCN that once it's paid, the case is closed-why then would they consider reopening the case just to review my appeal when cash is already in hand?
    So, my employer told me the only thing the leasing agency can do is give me the same letter that you wrote above and I have submitted this same letter several times with several letters to the council who issued the PCN-but it's all been on deaf ears, they simply ignore my correspondance and I can't seem to do anything about it.

    Surely, people who have employer leased cars should be able to appeal charges. I would love to escalate this higher, because on an ethical level this totally stinks. However, do I want that emotional investment, possible work related issues, expense, etc? I imagine this is how all the employer leased car companies operate, maybe forming an alliance is a better idea! Who's with me?! I just can't see how such an injustice is legal.

    What really pours salt on the wounds is that I pay for the leased car as well as have the tax burden. So, its not as if it can be considered a "benefit". Plus, with these PCN's that I have to roll over and pay for as well, without the chance for appeal-this is madness!

    I have a company lease car. Althougth my details have been released to these cowboys I have never had any money deducted from my salary by payroll.

    If they did deduct I would go after the lease company for potentially breaking the Data Protection Act. The reason for this is quite simple, what steps did the lease company take to ensure that I was the driver.

    Principle 7 of DPA states that the Data Controller (lease company) will take the necessary steps to keep the information secure. Just because someone says they want information, doesn't mean they get it.

    Most company lease vehicles are available for anyone in the company to drive if the company so decides.

    But come October they will have to release the information of who the vehicle is leased to, or they will pay it against their t&c's (normally) then try and chase that plus their admin fee with that person/company. Then it's down to your company and how they handle this.
    Excel Parking, MET Parking, Combined Parking Solutions, VP Parking Solutions, ANPR PC Ltd, & Roxburghe Debt Collectors. What do they all have in common?
    They are all or have been suspended from accessing the DVLA database for gross misconduct!
    Do you really need to ask what kind of people run parking companies?

    I really like your thinking here, because it's true-how can they verify it was me/my PCN? But, on the contract, I am the "sole driver". So, I suppose I am still stuck with admin fees from the lease company plus the PCN. Argh!
