ebay seller now says item broken, i suspect not

i bought an item on ebay and paid immediately through paypal. the seller took three days to get back to me to tell me he was giving me a refund as the item was broken as he knocked it over. i strongly suspect that as he got so little for the item he feels aggrieved. the item was incorrectly listed as it was misspelled, it started at 99p and there was no reserve hence few people found it to bid on. i replied in an email that i did not want a refund and my son would repair it and please may i have details to arrange collection. he has not yet responded. how do i stand in this situation? i am now the owner of the item still in his possession how can i prompt the seller to part with it. The price i paid was £6.49 for a used chiminea. thank you for your advice.

Ask him for photos of the broken item

You should also use his emails as the springboard for a non-performing seller dispute - there is actually a lot you can do to a seller at this point.
