Can I get my phone replaced not repaired?

Hi, I bought a mobile phone and contract 31 days ago but the phone isn't working right - no mobile connection, no internet, texting etc. The shop has agreed to a free repair but I want it replaced. They say I could only do that up to 28 days. Does anyone know if I have a right to a replacement or is it good enough that they repair it? I actually took it in on day 27 when it first went wrong, they took the battery out, put it back in again and it rebooted, but then I've had the same fault ever since. I didn't think to ask for a replacement then in case it would be alright and didn't know about the 28 days policy. Any help would be gratefully received. Thanks in advance

My guess would be that it should be replaced if that's what you want.
The initial problem that occurred within the 28 day period had not been permanently rectified.

Are they going to give you a replacement while your phone is being repaired?

They didn't mention anything about what would happen while it's being repaired, I was too busy arguing that I wanted a replacement. They've said that the system won't let them do a replacement so they've told me to go back to the store that removed the battery on day 27.

Going back there will be the best thing to do then, they will have the records of you going in.

Unfortunatly they didn't look at my record, they just took the battery out and said "there it's working now!"
