Payment of DLA

Hi I applied for DLA last march for my son and after refusal appeal etc he was awarded middle rate care at tribunal on the 1st June this year.. On the tribunal letter given to myself and Dwp it stated from aug 2011 and not march 2011.. Now because of this mistake on there behalf the award notice has had to go back to the tribunal service for correction this happened the 25th June after talking to them last week they have said this correction can take 8-10 weeks to be corrected!! Due to this DLA can not make any payments as they have to put the correct date into there system (even though they no this date eg from when my claim was put in) is there any way of speeding them up or DLA making payments before the tribunal service get back with the correct information? If this makes sence? Sorry if it does not....

    The tribunals service has the power to make any award the original decisionmaker could have done.
    One of these decisions (in march) would be have made an 'advance award' that he would become eligible for DLA in August.

    Hence, the DWP clearly can't pay you for the period from March-Aug 2011, unless this is cleared up that this was not really the tribunals intent.

    However, it seems unreasonable to not pay you the arrears from Aug 2011 to now.
    Or even just the ongoing DLA entitlement.

    I would suggest you request one of the above happens, ask for this request to be sent to a decision maker.
    On the tribunals side - you can ask for this error to be looked at urgently, if it's causing you hardship.

    Hi thanks..

    I did ask if they could just start paying the monthly amount and they gave me the answer that they needed the original date to put into the system so will have to wait...

    I will ring them again and ask if it can be given to a decision maker for a answer....
