I can guess too. I just wondered how the OH would justify his actions.

its worth saying that as part of the divorce process she'll be able to get access to at least 12 months worth of his business bank statements and if he's up to anything, that will be very revealing - it certainly was in my divorce anyway! the real issue is that the judge's hands are tied to what funds are actually available so if he spends, spends, spends there won't be much she can do.

I would advise she takes copies of statements from EVERY bank account, savings account, ISAs, investments, pensions, premium bonds, credit cards, loans, etc. etc. etc. and keeps these in a safe place (preferably out the house with a trusted friend) as when it comes down to it, he is legally obliged to declare everything he has. She should do this quietly and without any fuss or things will start going missing. You probably won't be surprised to hear that plenty doesn't appear on the relevant divorce paperwork and it is useful to have a copy of a statement which shows the bank account does indeed exist....if this is a big money case, it would make sense to speak to the solicitor about having his assets frozen if he is likely to spend. I would suggest she immediately opens her own bank account in her own name (if she doesn't already have one) and freezes joint accounts (the banks will do this) to stop him running up overdrafts or spending savings. If it's likely to get nasty, I would transfer money to her account from savings so she knows it's safe - she may also need it to live on if he's the breadwinner and she has little income. It is usual self employed practise to withdraw financial support.
