Think I've been scammed where do I stand?

Bought an item off ebay at £37.00 and received it but it was not as described was described as a leather jacket but it was PU not leather. Seller was not apologetic infact quite the opposite saying for £37.00 I was naive to expect I was receiving a leather jacket even though it was all over the listing real leather.
I returned item to seller by 1st class standard mail on wednesday without opening a 'item not as described' case.

Seller is new to ebay, never sold anything before.


I contacted seller today to ask if she has received item and said no did I send via trackable? I replying informing 1st class and she has repied saying I should have send it trackable and this is stated on ebay and now there's no way of it being tracked to her receiving it and she knew of this.


I know I should have send recorded, please don't say this I am well aware of this now. I have never received an item that hasn't been as described before.

In this situation which I have never been in before, knowing that I am being scammed, am I able to say item was not originally received by myself? or can our ebay messaged be viewed?

Where do I stand now??

    Firstly I assume you have proof of postage?

    1st class sent Wednesday might not have arrived yet, but if yu think the tone of her emails suggest that seller will deny receiving it then a call to eBay might be in order.

    I would not open an INR claim as our emails via eBay can be viewed by eBay and I just wouldn't risk lying.

    What should I say to ebay? would they be able to help me?

    I was thinking the same, INR is of course not something I have ever done before however just trying to get my money back and yes I do 100% feel that from her messages it is clear that will say that she won't receive it and she knows what shes doing. Shame she didn't know what she was doing when she listed item otherwise wouldn't be in this situation.

    If you have proof of postage then you can claim your loss from Royal Mail after 14 working days. Just a shame Royal Mail have to lose out if this item has actually been received by the seller.

    The item should have been sent by trackable delivery (such as Hermes or Special Delivery), not recorded. Recorded delivery does not always get a signature so is not reliable.
