    If you give money away, and then want to claim benefits you will be refused, simple as that because you will be assessed as if you still had the money so family will be expected to pay for the care, simple as that.

    I suppose all care homes are monitored or certainly should be, certainly firstly by the family of the person who are putting a member of their family in there.
    If you visit daily and your parent was in the care of someone who had someone caring for them who had another 10 to 15 'clients' and you didnt like it, then raise an objection if you dont like it, which you dont seem to do or move them,

    Someone who knows they are about to go into a care home giving away assets would be wilfull deprivation of assets. However anyone else can do whatever they want with their money. Are you suggesting people are not allowed to do what they wish with their own money? I state again that older people could prevent their money being swallowed by the blood sucking care homes down the line by getting rid of some of it whilst they are able and long before the dreaded words care home is mentioned. As an earlier poster mentioned do this early enough and wilful deprivation of assets will not be an issue. Of course any one older should first think of spending any money on themselves (travel the world etc) but please don't leave yourself in a situation where the courts control your money and then the care homes take you for a ride.
    If you want your family to benefit from your worth anyway then don't leave it too late or there may be nothing left by the time a care home gets its hands on it.
    I hope we just have our wires crossed Mckneff. I am not suggesting anything illegal as its completely above board for anyone to do exactly what they wish with their money as long as they are mentally aware. It's similar to tax avoidance as opposed to tax evasion.

    I agree up to a point, you have to do it early enough, we agree on that point, but its a case nowadays of people not being savvy about it.

    We changed our joint tennant status to tenants in common on the house 10 years ago. Just for this reason, but even then it might not work because of Government rules.

    If you get rid of your money and have a house, the house has to be sold, if it cant be sold forsome reason or another, the council can put a charge on it so that when it is sold, care home fees have to be paid then.

    Again, means tested benefits are also involved, if you own a house and have no cash, you are refused, sell your house to live, see what I mean, we actually have no chance.

    So in actual fact, you can give your money away up to a point but certaiin things come back and bite your family in the butt that us
    mere mortals are not aware of till it happens.
    make the most of it, we are only here for the weekend.
    and we will never, ever return.
