Hi, I need some advice please. My lovley neighbour is having extensive work carried out to his house, he has yet to complete his dromer loft conversion. He has already knocked out the chimneys from his side of the house and in the process he has damaged the party wall seperating our terraced house, the plaster has come away from the wall on my side of the house and even bricks have been knocked through.. cracks have also started to appear around my house as well as distortions in my walls. My insurance company have told me to send them a surveyors report which will confirm the damage and the cause of it, they say without this they wont do anything. The work my neighbour carried out was subject to the Party Wall Act but he has refused to acknowledge that he needs to do anything or cover any damage he has caused. The act has no enforcement powers, building control from the local counsil dont either and i cant afford legal action to stop any further works. My neighbour has not finished the works yet he still has the loft to do and the surveyor i called said it would be better for me to have a full survey done after the neighbour has completed the works in case my house is damaged further..my question is, my insurance company wont tell me whether they will pay for the damage they say they have to see the surveyors report 1st.. does this mean they may not pay out?
