Working tax credits : Over estimated a claim 2 years ago.

Back in 2010 i became a self employed subcontractor in AUG and rang the WTC helpline to declared my change in circumstances. I gave them my new predicted income and come April 2011 i got my end of year statement and declared my final income for the year 2010/11

For the following year i was self employed for the entire year and when i got my end of year statement i rang up again to declare my end of year figure, the adviser on the phone told me that i was to declare my profit and not my entire wage.

Meaning that for example;

I was paid £12500 from my employer for the year
But after i took of my expenses, for example fuel and tool costs which was approx £4000 for the year, My take home pay was £8500. This was the figure i was to declare.

I got a refund for the year 2011/12 because i predicted my entire pay and not the figure i declared on my tax return.

I was unaware of this for the 2010/11 WTC declaration and from AUG 2010 to April 2011 i submitted my entire earnings and not my profit.

I rang the WTC helpline and told them that i was unaware at the time that i was only to declare my profit and gave them my actual figure ( which was that figure i was supposed to submit back in April 2011 )

The lady i spoke to on the phone explained that the claim would have to go to head office as it was an old claim and any changes to be made would have to be made by them.

But because of this there are legal issues in regards to changing it and i may not get the money i was supposed to receive.

Has anyone here had this same problem and received there underpayment or can anyone here explain what the legal issues are as i was told i was to wait 15 weeks before i can here back about it as money is tight and i dont think i can wait that long for a decision :o
