Excellent spanked again ! twice Minster have gone before the courts and twice they have been well and truely whooped :rotfl::rotfl:

Goes to show newbies that if you follow the advice you are given on here, IF and it is a big if - it ever does goto court then with a good defence which you will get from the likes of Alexisv on here or the guys on pepipoo then chances are more than favourable of you winning not the ppc, and you can claim your costs back as well to make them smart even more.

And a link to their last spanking just over two years ago http://forums.pepipoo.com/index.php?showtopic=52571&st=0&gopid=482089&#entry482089

It seems a very peculiar set-up. Are they Minster Baywatch or Bransby Wilson? Anyway well done to that Motorist for standing up to them.

Even two years ago Mr Wilson was confused about the status of the two companies:-

Mr Wilson turned up to represent Minster Baywatch. He is the Managing Director of a company called Bransby Wilson Ltd. Apparently they hold the contract with Rank and Minster enforce the ticketing.
He couldn't really articulate who Minster Baywatch are and how he was representing them. He said they are a Ltd company which they are not.

One of the main issues is that no one is 'Minster Baywatch'. Its not a company, nor is it a trading name.

And yet they tried to bring a court claim. Clever clever stuff.

    Not.

Something's not right here. From Bransby Wilson's website:-

    About Us

Bransby Wilson has firmly established itself since 1991 as one of the UK's leading car park management companies.

But this from Companies House :-

    BRANSBY WILSON GROUP LTD
    3 MILLERS YARD
    GILLYGATE
    YORK
    YORKSHIRE
    UNITED KINGDOM
    YO31 7EB
    Company No. 07535730

    Status: Active
    Date of Incorporation: 18/02/2011

    ???????????????

No reg company details on BW's website as well as no VAT reg number, same on minster. Me thinks an email to the HMCS might be in order from a few of us ? get them in court like VCS

Isn't it interesting how many instances we see of this despite the British Parking Association's code of practice for the approved operator scheme saying (at 3.2):
Under the Code you must keep to all the requirements laid down by law.
    and then:
If there is any conflict between the law and the Code, the law will prevail
How many AOS members fail to comply with the various Companies Acts, eCommerce Regulations etc?
My very sincere apologies for those hoping to request off-board assistance but I am now so inundated with requests that in order to do justice to those "already in the system" I am no longer accepting PM's and am unlikely to do so for the foreseeable future (August 2016). :(

For those seeking more detailed advice and guidance regarding small claims cases arising from private parking issues I recommend that you visit the Private Parking forum on PePiPoo.com
