Assured Short Hold Tenancy Breach & Avoiding CCJ

It is true that you can't get an attachment of earnings on benefits.
However, your current landlord can get an attachment of benefits, and that will change with the introduction of 'Universal Credit' to cover all judgement creditors.
You come on here asking for help how to (essentially) defraud your landlord. However, you seem to delight in proving the posters who have given their time and effort to guide you wrong (and failing - but that's another story). How to win friends and influence people.
Maybe, if you want to draw posters attention to other sources (and goverment websites ain't the law) then you should sumarise the relevant bits and provide a link to the web page. That way, you save us having to read through all the **** and prove to us that you haven't made it all up yourself.Life should be a little nuts; otherwise it's just a bunch of Thursdays strung together.0 -

Thank you, I am looking into Attachment of benefits now.0 -

1) Attachment to benefits: Only available whilst tenant is your tenant.
2) TPDO - you can ask for an 'order to obtain information' which involves the tenant going to court and being asked a series of questions. Cost £50, plus a further £50 if you require the bailiffs to serve the order (it can not be posted). TPDO only freezes whatever money is in the bank account on the day the bank recieve the order - if it is the day before benefit day you may be out of luck.
3) Warrant of execution will cost £100 but may be pointless, there isn't much of a market for second hand goods, and the bailiffs are limited in what they can take
So apparently if I move out of this property then LL can not apply for attachment of benefits order (stop my benefits)
I could move out and rent a room much cheaper, LL could not effect benefits? or apply for Bank account Arrest? (If i close the account which I transfered rent money from) Plus IF I did get CCJ it would be cleared after 6 years any way.?0 -
So you are planning to remain out of work for 6 years are you? If LL chooses to go for an attachment of earnings, he could delay and apply after he has traced you and found out you have secured employment. Applying for a CCJ then, would mean he could apply for attachment of earnings then!0

If the OP spent as much time and energy on sorting their affairs properly as they appear to be wasting scouring the net they may not need to be worrying about CCJs and hypothetical attachments of earnings.....0

This whole thread is very confusing in light of the considerable savings (£30,000) the OP supposedly has...Last year you mentioned having over £30,000 in savings ready to invest in property.
