hi i hav been getting esa(the one where your never going to be fit to work, not sure which group that one is ) since i came out of hospital 2 years ago and now hav just received a form to fill in which i assume is to re-apply, i contacted my welfare office who filled it in for me however he said not to send medical reports or consultants letters but to hold onto them til they ask me to go for a medical however my concern now is that they make a decision just on the basis of the form which i dont have the greatest confidence in as every question and answer can be interpreted whichever way possible unless accompanied by documents or me sitting there, also this denys me the chance to submit my evidence, have i been looked after correctly by my welfare officer or should i have sent it all, surely they will want a face to face medical, please help me my mind is worried sick waiting to hear...

I wouldn't worry about it, if you've already sent your forms in.
They can't make a decision to stop your ESA entirely without first inviting you to a face to face assessment.
So I assume you're concerned they place you in the wrong ESA group ie WRAG instead of Support (which it sounds as if you're in) without a face to face assessment, based only on information put on your form.
Even if they did put you in the wrong ESA group , you have a 4 week period from the date the intial decison is made to appeal your group placement , when a decision maker from DWP reconsiders your claim. You could then send in a copy (never originals) of all your medical documents at that point for him to consider.
Some people have posted they included loads of documents with their initial forms to ATOS and they just ignored them, or worse lost them.
I'm sure more knowledgeable posters will be along shortly, but in the meantime try not to worry.
The ATOS process is very stressful , and both sides of government and the minority of people who abused the system in the past should be ashamed of themselves for the stress genuine claimants are now being put through.0 -
thanx for the reply i really appreciate you taking the time to answer, i do feel better now, i am not too worried about being put in the wrong group as i am not knowledgeable on the matter just was worried they might stop my money altogether or something...i just find it all baffling as i have met the criteria to release my dwp pension on the grounds of ill health at the age of 38 which they started paying me last year and that was a stringent medical done by benefit agencys own medical team where they agreed i would never be fit for work before retirement age and then on their other hand they are saying fill this form in so we can see if your fit for work, its distressing but laughable if it wasnt so serious..again many thanx for the reply0

I think they are concerned they may have to attend a medical when otherwise ATOS could waive it.
They are already in Wrag or Support this is for a re-assessment.
Yes there is the possibility given more information they could assess there is no need for another medical.
If you turn up for the medical on the day and hand in your additional info, I don't know if it will be looked at, but I would hope so.
It's really up to you to decide what to do.0 -
The suggestion to hold onto them till they decide to send you to a medical is wrong.
If you supply them to the DWP now, it gives them the chance to decide you don't need a medical, and will make it more likely that the first decision is the correct one, without needing a lengthy appeal.0 -
But make sure you only send in photocopies and recorded delivery of any information you send in.well today was a complete waste of make up :eek:0

Sounds like a reassessment and sounds like you've been sent ESA50 to complete. On ESA you are regularly reassessed and the ESA50 is used in most cases to form part of the evidence for that assessment. If you have supporting evidence I strongly advise sending copies of it with ESA50.... it would be silly to hold that evidence back when it may influence ATOS HC view of requirement for face to face medical and indeed their advice on you in relation to WCA. You could supply it on the day to the HCP but you may never get that chance... you may not get a face to face medical.
