Bank fraud

Dear sirs,
On the 30th April, Fraud was commited on by Santander Current account. I was only aware of the fraud when they texted me asking me to contact them urgently. When I did they read out a number of of transactions and asked me if i recognised them. I didnt and a stop was put on my account. Among the Transactions was £320.00 that was paid into my account by a company called Express Finance. My wife was in hospital at the time and I recall speaking to my wife during visiting times to ask if the transactions were anything to do with her. They were not. So I rang the Fraud department at Santander on 08453512275 and I reported this was the case to them and I also advised them of the £320.00 that was paid into my account did not belong to me and they told me they would investigate everything.
During the investigation, several phone calls made to and from santander and I recall mentioning the £320 on more than one occasion and they told me to ignore any letters I may get while the fraud investigation was being carried out. I had tried to find out where this money had come from on my own but i was unable to locate where it came from. On my statement it said Express Finance. I heard nothing until Monday 23/7 when I recieved a letter from Payday express asking me to pay back 480.00.
I contact (Text removed by Forum Team) from this company 1800 on 23/7 on 08000126347 and he told me to get a crime number off Santander. I rang Santander at 18:20 on the same day (Text removed by Forum Team) who told me they couldnt give me a crime number because the case was closed. I then spoke to (Text removed by Forum Team) payday who said I would need to make arrangements to have the money refunded back to them and I must claim false application.
I then reported the matter to the police (Text removed by Forum Team) and then emailed over the incident to [email] collections@paydayexpress.co.uk [/email] under client ref no 2182294
The police visited my house this evening and the reporting officer said that because I wasnt the innocent party he could not give me a crime number and Santander and Payday should be investigating this between themselves and told me that this is all that Payday would require.
I then rang Santander at 1925 on the fraud telephone number 08453512275 and (Text removed by Forum Team) got extremely upset. She told me The fraud department do not investigate money paid into accounts from payday loan companies and that I must have arranged it. When I told here that i had not, she asked why would someone put money into your own account under your name? I told her that I had been advised that because the fraudster had not been succesful on a number of transactions, he/she had probably become frustrated at not being able to commit the fraud and as revenge, put money into my account using my details. She said she had never heard of that before and she refused to investigate the matter any further.
During the period when my bank account was suspended, i was unable to get balances, pay direct debits, or carry out other transactions however, standing orders were still being taken. One of them £275 was for my IVA providor, express debt solutions. During the period that my account was suspended, some of that £320 was used to pay bills, standing orders and direct debits but I was unaware at the time it was eating into the £320 because i could not get balances.
I am now faced with having to pay a bill of at least £320.00 back to Payday Express and potentially £480.00 because I have been told from an outside source that without a crime number I will have to pay back the full amount.
Obviously, I am very upset at this and wish to take advise on what to do next.

You do not have to put the names of all those you spoke with in your post, i think people will get the drift of your story without it. Also since you intended paying off your direct debits and all anyway, why dont you use those funds to pay back the pay day loan and explain to them that since it was paid to you in error or fraudulently you will only be repaying the exact amount erronously or fraudulently paid to you.
What to do next would be to speak with the payday loan company and pay them back the £320 with the money that you would have used to pay your usual out goings.0 -
I fail to see what the problem is and am unsure as to why you've posted every name of anyone you've spoken to today and also your own?
just pay the amount back to the loan company, I can't see why anyone would apply for a payday loan, and have it deposited in your account, what good would that do them?0 -

You are liable for the £320 payday loan that was fraudulently deposited.
It is not clear from your last paragraph how that money was spent. You say it was taken to pay bills & your IVA payment. Would these payments otherwise have failed if you did not have the extra £320 in your account?
You say you could not access your account balance during the time it was suspended, so were unaware that the £320 was being spent. It is highly inconvenient not to be able to see your balance, but a normal flow of debits and credits should have kept your account in normal balance range during that time.
Surely the £320 must effectively have been spent on something else. Otherwise you did not have enough money to pay your next set of bills.
And if you did not have the money to pay your next set if bills, then your finances were effectively saved by the fraudulent payday loan credit and morally you should pay back the full £480 being asked.0 -

A stop had been placed on OP's account - "During the period when my bank account was suspended, i was unable to get balances, pay direct debits, or carry out other transactions".You are liable for the £320 payday loan that was fraudulently deposited.
The OP is not liable for the payday loan. OP has not entered into any contract with Payday Express.
What the OP needs to do is
1. Refund the £320 to Payday Express. Send 'em a cheque.
2. Complain to Santander about their distinctly unhelpful attitude - the fradulent transaction was identified 30/04/12 but was still unresolved on 23/07/12
3. Consider the probablity that the fraudster was looking to be able to spend the £320 out of their account somehow, and that their account security may have been compromised.0 -
If it was card fraud, it's usually just the card which is stopped, the account remains open and active.
The OP's account must have been unsuspended at some stage in the last 3 months, i just wondered why they haven't paid it back before now ?0 -

Originally all the OP knew was that £320.00 had been paid into their account by a company called 'Express Finance'. Typing that into Google reveals at least four possibilities; it wasn't until the 23rd July that they received a letter from Payday Express aka Express Finance (Bromley) Ltd that they knew exactly where the money had come from.
If someone mistakenly pays some money into your account you're under no particular obligation to go running about the place trying to find out who it is that has made the error. You're perfectly entitled to wait for them to get themselves sorted and contact you.0 -
Stop! All posters - please note OP is not liable for any payment to any payday loan because he did not arrange it.
Paying it back would cause more problems.
The bank should remove the funds and deal with it themselves.0
