Does S75 apply on overseas purchases?

Hi all,
I'm not sure if this is even in the right thread but I couldn't find any information on it anywhere else so here goes.
I'm thinking about making a purchase from Miccostumes.com, a company that is based in Hong Kong. Now this company has lots and lots of glowing reviews but I recently discovered that it is a subsidiary of Milanoo, which in the cosplay community is considered to be the black plague of customer services and actually providing any service at all.
The economy shipping for some reason is more expensive than the express shipping, which is sort of ringing alarm bells..but the products there are of much much higher quality than I have found anywhere else.
Anyway, my question is this: The purchase will be over £100 and it will probably be paid on a credit card via Paypal. So, if the worst reviews are true and the item never turns up or is of rubbish quality, will Section 75 apply? And if not, what other protection can I get?
Again, not sure if this is in the right place but I'd appreciate any and all help I can get on this matter :)

    If you are paying via Paypal like you mentioned - No Section 75 Liability.

    They do however have their own disputes process if you didnt receieve the item/faulty goods etc which if you adhere to the timescales you should be alright.

    If you paid the company directly on your credit card Section 75 would apply to the transaction should there be an issue.

  • Oh really? I didn't realise that Paypal protected me outside of eBay. Duh.

    Well PayPal's protection and refund policy is entirely their own arbitration and is unregulated as far as I know, so there is still a risk. For example PayPal would be happy to give the vendor your money if there is proof of delivery of the goods, and is unlikely to refund you if, for example, the goods are not of merchantable quality.

    Having said that, PayPal does tend to side with buyers rather than sellers in disputes.

    But it would be foolish in the first place to conduct any business with a company you have concerns over, whatever recourse you feel is available when things go wrong.

    Paypal will also ask you to send the goods back if there is a problem with quality etc. Sending back to China with tracking can be expensive with little to no hope of recovering this cost. If in doubt by in Britain from a reputable retailer.
