Work this one out!!

Today I was issued with a PCN for parking in a space that I own for not showing a valid parking permit. In light of the fact I own the space and it was the management agency who employed the parking company is the ticket valid?

Secondly if by now asking them for a new parking permit does this mean I accept there authority to issue parking tickets, even to me for my parking space?

    Its not even a PCN (although they use language that will fool you into abbreviating it as such). Its an invoice.

    And, technically speaking, unless they've changed the terms of your lease (which I very much doubt) they've actually trespassed on your land to issue the invoice.

    I would ignore it completely. Ignore all the follow up threats of legal action. It won't happen. They'd get a spanking in court, and they know it.

    Bringing a claim of trespass against someone who is 'trespassing' on land they actually own wouldn't last five minutes in a court. 'Not displaying a permit' wouldn't get very far with regards to a civil claim either.

    You might actually want to put in writing to the Management Company that, in the absence of any variation to the terms in your lease, you have chosen to opt out of their permit scheme, and that you hereby withdraw all implied access rights to the space to them and any agents they employ.

    In reality, the Management Company only have jurisdiction over the communal areas of your car park, and cannot patrol the spaces without your consent.

    The only people to suffer when a building management company bring in a private parking company are the residents. I can't wait for mine to make the same mistake. They won't know what hit them.

    Write to the building management company, advising them that they are "jointly and severally liable" for the actions of their agents, the PPC, and that any further actions by either of them would be regarded as harassment under the terms of The Protection from Harassment Act 1997. This ought to make them call off the PPC and, hopefully, realise the potential cost of doing business with a PPC.

    Unless it’s a condition of the lease, you can opt out of any parking scheme.
    The acquisition of wealth is no longer the driving force in my life. :)
