Are Council out of time?

Hi All

I received a PCN in May 11 and appealed, eventually I received a charge certificate so appealed to the Traffic Enforcement Centre (TEC) as I had not had a postal response to my representations, nor did I receive the Notice to Owner(NTO).

The TEC upheld my appeal, I mistakenly thought that was it, but today received a new NTO from the council.

The TEC decision was 29 Feb 12 and the NTO is 24 July 12.

My question is whether the NTO is tithin time, as I'd be surprised if they get 5 months to issue a new NTO.

    Time limit to normally serve an NTO is six months. When an appeal to TEC is upheld, the process is re-set to the NTO stage, thus allowing you to make formal representations, and if rejected, appeal to the adjudicator

    But I don't know whether the six month limit then also applies to the issuing of the new NTO or whether there is a shorter timescale

    But pleeeeeease read a few threads there first and the FAQs because they will need to see all your documents (just cover the car reg, PCN number and your name/address). Other than that, show all other dates & details, show both sides of every single piece of paper plus what you responded with as your appeal.

    They will want to help you but without pics your thread will be ignored, so don't just post like you did above (which is fine on MSE but pepipoo is a forum where they need pics). Do some scanning first of every page (front and back of the PCN etc., all the small print, all the appeals gubbins, the lot). If no scanner then use a mobile phone or digital camera on close-up mode.

    Bottom line is that if you are at NTO stage now then it would be daft to just pay up now. You may as well appeal all the way because the discounted penalty has long gone and if you did lose at adjudication (which is just a meeting) then you only risk having to pay the same amount. But there's more chance that you will pay nothing because most people win at adjudication and most pepipoo posters win as well. You will be in the best place on that forum.
