Me and the wife separated at Xmas and we met today to discuss a divorce. Things are very amicable, there's no kids and no assets.
We basically drifted apart, communication broke down she found out I had a large amount of debt I didn't tell her about. Lots of reasons:(
We basically want to get it done as quickly and cheaply as possible. My wife met with a solicitor and suggested that she uses me "hiding" my debt from her as grounds for divorce. The solicitor thinks this will be enough. I'm willing to accept this but want to check what this would mean in the future. Who can see the records? will it affect anything if I decide to marry again etc...
I'm due to meet a solicitor next week but was looking for some advice from you lovely people.

No not at all. Our lack of communication (among other things) caused the breakdown of the marriage. Us not discussing my debt was part of that. It's all a big mess.

if you both agree and both want to keep it cheap, you do not need a solicitor to divorce. Download the forms off the net and pay the £380 court fees.

I did this last year with no problems - in fact I think it goes through quicker because there are no solicitors to act as go betweens. Provided that you both agree a financial agreement (in my papers I just put that an agreement had been reached, you don't need details if there are no kids) it should get through ok.
I used unreasonable behaviour at the request of my exOH as a bit like you there were differences and secrets (nobody else involved) and only put the briefest of explanations. Noone questioned it and it was all done in a matter of months for £380 plus £60 (I think) for the decree absolute.

Unless you have been separated for a period in excess of 2 years the only grounds for divorce are adultery and unreasonable behaviour. Therefore even if it is amicable, you will still need to lay blame so to speak and give a few reasons. If you do not give a few good reasons a Judge could decide the marriage hasn't irretrievably broken down.
A divorce is a divorce so it is irrelevant really who divorces who but when you divorce someone you can include a claim that you want the person you are divorcing to pay your costs so make sure you agree if she is divorcing you that she will not go after you for costs.
Agree on the other points at unless you get a financial order from the Court, either of you will be able to come back against the other for years to come. The Court's website has quite a few good informative sections :cool:Just keep swimming!0
