Solisitors making mistakes

Hello everyone,

My Girlfriend and I are in the process of buying our 1st house and are understandably excited!

In all correspondence our solicitors have said we will aim for completion on 30/31 July - she even emailed me asking which date I would prefer, to which I responded 30th is great, sooner is better!

I received a letter back saying we will go for 30/31st anything sooner ie 27th would incur and expedition fee of £85

She went on holiday a week and a half ago and left the work in the hand of a colleague.

That colleague called me on 24th and said completion will be 30th July you can pick the keys up from the Estate Agents, though if you wish you can move in on 27th and pay £85 - I turned down the offer of 27th but agreed to 30th.

She rang me the next day and said "sorry forgot to mention 30th will incur £85 fee... I kicked up a fuss and said no, she said 31st would incur no fee.

Well I wish I kept my gob shut.. I argued that we wanted 30th as agreed, plus we spent the rest of 24th arranging home insurance, skip hire, annual leave from work and confirmed the builder for that week. I asked for a superior to call me.

The superior called and said that no exchange had taken place, we wouldn't get the keys for at LEAST 10 more days but as a good will he would lower the expedition fee to £42.

A few angry back and forth emails later and the solicitors are denying all knowledge of the phone call and the lady that called me wont return my emails/calls only the abrupt, rude senior solicitor will reply and he has put up his wall!

Where do we stand?

    You will need to look at the terms of the contract you agreed with the conveyancers. I'm guessing this is an online/mass-market/conveyancing outfit, not a local solicitors!

    What is the 'fee' for exactly. Are they entitled to charge it and in exactly what circumstances? Only their terms of business (contract) to which you signed up, will answer this question.

    In conveyancing, this is all conveyancers can do. 'aim'.

    Until Exchange of Contracts there is no guarantee of any date.
  • Just buckled and paid the £42. Should hopefully be in on Monday.

    Wish I had patients sometimes...
