Premier park l - PCN

Hi Just hoping someone can give me some advise. I received a parking charge notice from Premier park Ltd for parking in a popular restaurants carpark. The letter includes photos of my car with the date and time on them. It states " has been issued this for the alleged contravention of " None Patron". I have ignored this letter but have now received a second stating the fee is now £100. I have parked here on numerous occasions normally because I need to breast feed my 3 month old baby so i do not leave the vehicle. There are signs up to state this is parking for the resaurants.

Should I pay, appeal or ignore. If I ignore them what are the chances of them taking me to the small claims court, especially as they have photos. And what are the chances of them winning. Also do these companies ever win....

    just keep ignoring them. if you have a look over on the stickies, it will give you an idea of the letters you will get.
    chances of them taking you to court are slim to none, and if they do, you will get enough help from here to build your defense

    Ignore them. They won't take you to court because they would lose.

    You'll get a standard set of letters from the standard set of make believe debt collectors and solicitors and they will then dry up.

    A lot of them do. Not sure what the PPCs do with them, they're of no earthly use to them whatsoever.

    Maybe they might take your car to court!

    What do you think they could possibly use the photos for ? Say a complete stranger stopped you in the street and gave you photos of their car - what could you do with them ?

    sazzles,, its a SCAM, so why worry,,only a PENALTY charge notice is legal, you dont have this,,you have a PARKING charge notice=loo paper, so there you go, jobs a belter innit,now relax, feet up,glass of wine.

    What they are doing is an Equality Act breach against you. Linky.

    ''Service providers must not discriminate, harass or victimise a woman because she is breastfeeding.''

    If it were me I would actually get out of the car next time, with baby, and go into each restaurant and ask for the Manager to confirm that they do allow a woman to breast feed in the restaurant and/or in the car park? Word it like that, mention the car park as well as the cafe/restaurant.

    And if you don't want to ask face-to-face then why not ask a friend or relative to ask on your behalf? No need to mention any parking company rubbish.

    See what answers you get, you will soon suss out the friendliest one, and go ahead and grace that cafe/restaurant with your custom every so often. Even just for a drink & piece of cake or something and in future you could feed your baby in there instead of hiding in a car park.

    Depends on the answers you get to your enquiry but I would hope they would be favourable as restaurants/cafe Managers should know by now that they can't ban you for breastfeeding.

    And as regards 'should you pay or appeal' I do hope you have read the sticky thread (second to top at the moment) called 'PPC letters & threats'.

    You are not liable to pay and you must not 'appeal' either. This is a private company with an unsolicited invoice, dressed up to impersonate a parking ticket.

    OP got the scam for parking in the car park, not for feeding.

    Just the same as if you parked up in the next bay, at the same time, and left at the same time without visiting the establishment, they would try to scam you aswell.
    So i dont think it would be seen as discrimination... too many people nowadays try to play that card to get out anything. (

    (defo not saying this is what the op has done, but pointing out that so many people play discrimination if something doesnt go their way or they are unhappy about something)

    In my answer I encouraged the lady to use the cafe/restaurant sometimes as I felt that was reasonable (and more comfortable for her).

    But the Equality Act is worded to make 'harassment' a specific element of discrimination - and to allow a parking agent to harass a breastfeeding woman with 'fake fines and threatograms' is IMHO discrimination under the Act. Legally, she should be able to park or sit somewhere without bothering anyone, to feed her baby, and as long as it's not a full car park she won't be causing the occupiers any loss.

    Simply to harass her is discrimination AIUI. You are right, the fake PCN is for 'parking' and the PPC won't have known what she was doing...but then they don't understand or give two hoots about the Equality Act anyway, we know that on this forum.

    I think, like the PPC, you may be assuming that you can only use the car park if using a restaurant? The OP doesn't actually say that and may not know either way. Often such an assumption is made about a car park but very, very often in a town centre car park it is a wrong assumption.

    There's a Tesco near me which only got planning for a car park by allowing people to go off-site - and there's NO need to visit Tesco. They hate it I am sure but it's a fact that the Council insisted upon it to let local people use local shops and have ample free parking at no cost to the Council.

    And there's a well-known Aldi which got fined by the Council for breaching just such a condition. They then tried adding a sign the other week, saying 'Aldi customers only' but soon had to tear it down when one of our members here told the Council! :rotfl:
