    Missed the perspective point, my illustration was that bank x will not accept anyone with a CCJ. Client a has a CCJ so they refuse him - is this discrimination - no it is their policy, same as the nationality and residency conditions that they set.

    CCJ isn't a discrimination. Discrimination is telling a non-eea national that it has to be a permanent resident. Since EEA national doesn't need to be, hence why non-eea family member doesn't need either. As I said it can be their policy, but it can infringe EU directives.
    I am not saying it is fair or unfair, just that you are going to waste your time, money and effort pursuing it based upon a feeling of injustice and your interpretation of the law..
    If I had that approach of 'wasting my time', surely I wouldn't go for it. I have a very strong case and based on a legal advise I'm going to get by the end of the week, I'm going to make an official complaint.

  • I am not a an EU national but I have bank account with these bank hsbc for last years and told them to see the balance i maintain if they want to confirm my credit worthiness .I even told them to look at the balance amount I maintain but they said its the policy NO PR NO Mortgage.

    Also some of you have mentioned good mortgage broker, is their a list produced by an independent body about the brokers which can be trusted. As it is evident I am new to this mortgage in UK so have very little knowledge or contacts .Apologies in advance if its stupid question.

    Are you spouse of an EU national? If yes, then the bank is discriminating against EU treaties and directives.

    If you came as an immigrant and has a different visa, then the bank might have a case to demand PR, but definitely not to EEA nationals and their family members.

    There are at least 2 threads on the above that are very instructive. I am on a Tier 1 Visa and my spouse is British. We successfully got 2 mortgages this year. A BTL and a residential. We had 25% and 40% deposit respectively. Some turned us down due to residence issues as I had just under a year left on my visa.

    We researched thoroughly and got both. To be honest, I don't blame the banks. I and my family have a choice of countries to live in, here and somewhere else and I agree that makes us a bigger risk. I would look at it the same way.

    Lenders can decline your application on any grounds they wish.

    There is no automatic right to a mortgage.

    Funny that people got sent away by HSBC, as I dealt with a Canadian girl, who had no PR and still got a mortgage from them a few months ago. Granted, there were certain conditions she had to satisfy. But indeed there are banks who are more lenient and I have arranged mortgages for Australian, US, South African and Indian citizens. Admittedly the choice of lenders is limited, but it is possible to obtain a mortgage.

    There are various lists of brokers, but it a very personal service and one person's experience may not be the same as another one's with the same advisor, so it's more like about finding a broker you feel you can trust. Recommendations are a good way or just doing an internet search for your area and go from there.

    HSBC are quite very strict. They wouldn't touch us because we both had late 1 late payment each dating from late 2010 otherwise we both had more or less pristine credit records. They will lend with 12 months left on the visa.
