You won't get a reduction on points. Guidelines are 6-8.

If the court accepts the mitigation then they can choose not to endorse.

Aretnap has given the details in post #11.

Correct, but happy suggested a reduction for a guilty plea. That won't happen.

There is no option but to plead guilty, either you have insurance or you don't... in this case the OP didn't so guilty!

The mitigation is that the OP genuinely believed they were insured (as per Aretnaps post). If the court were to be convinced then the OP would still be guilty but point's may not be awarded.... they have the discretion!

No need for the bold, I read his post. Shame you don't read what's written. If the court decide to endorse the op will not get a reduction in points for an early plea.

Shame you have to wriggle on what you posted

If you were referring to an early guilty plea only then maybe you should have made that point, don't you think?

The maximum fine is thousands possibly even a 12 month disqualification...however you won't get that. You have mitigating factors which will mean you will get a fine of probably £200 plus court costs whatever they come to plus victim surcharge of £15. The sentencing guidelines state that your licence must be endorsed with 6 points if found guilty but they also say consider a reduction for an early guilty plea.

For completeness sake I'll point out that a reduction in penalty points for a guilty plea does apply in Scotland, but not in England where a guilty plea only affects the level of the fine. Even in Scotland though a guilty plea can't take you outside the statutory range, which for no insurance is 6-8. The magistrates have various options. They can give you 6 points, 7 points or 8 points; they can ban you outright; in exceptional circumstances they can impose neither points nor a ban; but one thing they can't do in any circumstances is give you 5 points.

  • If the court accepts a guilty plea but doesn't award points, doesn't it still count under the question "Have you had any convictions etc?". If that is the case, the OP may still find it hard to obtain cheap insurance or hire cars.

I would agree around insurance, but with car hire I dont think they ask the question they look at your licence which wouldn't have any points on if the judge is allowed not to award any.
