Removing old registered charge on title deeds

Hi,

In 1998 my parent in laws re mortgaged their farm. They split the property into 2 sets of title deeds, 1 for the land and the other for the farm house. They were to retain the land mortgage free and borrow money against the house. For some reason which is unclear a charge was registered on both sets of deeds for the same mortgage company.

Since then they have remortgaged on the farm house a number of times but the charge on the land has remained unchanged.

They would now like to sell the land but have been told they cant until the charge is removed. The mortgage company listed on the charge went into liquidation in 1999 and their solicitor is struggeling to find a successor to the old mortgage companies assets to remove the charge.

The land registry have said the charge can be discharged but only if sufficient proof can be provided. Their solicitor has been given all the information my parent in laws have but appears unable to get the charge removed.

Are there any alternative routes to having the charge removed or any other advice would be much appreciated?

    Only the LR can remove the Charge. They have requested " sufficient proof" which is not surprising.

    So their solicitor will have to pursue the question of who took over from the lender.

    What is the name of the mortgage company? Someone on here may be able to provide some helpful info.
  • The original mortgage company was called first alliance mortgage company limited. They may have been taken over by a company called Paratus although they seem to have stopped trading very shortly after!

    Everyone their solicitor tries to contact either has no record or doesnt reply which I would have though would be sufficient evidence to show that no one has a vested interested?

    That clearly isn't the case - just because you get no response is no indicator in any way that a vested interest no longer exists.

    So that's 5 minutes work, for which the solicitor's will charge a minimum of an hour I would guess.

    And then there's how many hours they have charged so far ?

    Presumably they will forwarding my fee shortly ?

    (I retract the sacasm if its the wrong Paratus - I don't have the benefit of the initial paperwork [but they do seem to match the activity] - but I bet they would know of any other company of the same/similar name)

    Sometimes I doubt it!

    First alliance changed to RFC mortgages before going to Paratus. I think they have remortgaged after this with oakwood home loans!

    My concern is that if non of these companies have any records relating to that title number, the mortgage company on the title deeds doesnt exist anymore and my parent in laws dont have any further evidence to support their claim they will have run out of options if the land registry wont accept this as sufficient evidence.

    Dont realy know what else to do as their situation is getting quite critical and this has been ongoing for over 3 months now.

    :cheesy: whatever you want just as long as you can help get the charge removed!
  • If your solicitors can't sort this out in a morning I would be of the opinion that you want new solicitors.

    Strictly speaking this doesn't even need a solicitor - you (or to be more exact your paents) - could do this themselves - and/or could commission help from any suitable third party (they would just have to sign documents as only the registered tenants, solictor or licensed conveyancer can sign).

    It should be comparatively easy to trace this through (as I just demonstrated - you hadn't told us about Oakwood) and get the individual companies to confirm they don't wish to hold charge.

    You woudl need to confirm what mortgages/charges you believe to exist.
