ex kicked son out still claims c/b and working tax credit for him

Hi everyone,son got kicked out of his mums house when she was drunk (hes 18)told to go live at mine.Anyway two months later hes still here and the ex is still claiming c/b and wtc for him(hes in further education)and is adamant she not going to let me claim for him /or wants to pay him some cash herself while still claiming wtc and c/b for him?is this fraud ??
anyway put a claim in for child benefit for him and shes gone ballistic???

    Not entirely. She has 13 weeks during which she can keep claiming if he "may" return to live with her.

    After that, you can claim the CB and CTC.

    she can clain Child benefit even if the child does not live at her house but she must be paying at least as much as she gets for child benefit towards his keep, if she is not paying anything or less than the benefit then yes she is claiming against the rules.

    Not sure on when it becomes fraud, if she has to know she is breaking the rules first so you best watch what words you use when talking to people but the least she may be doing is claiming money she is not entitled.
