Money for stocks used to pay of gambling

Hi I hope someone out there can help me (Not sure if this is the right post though).
In December 2004 I loaned my brother £10,000 as he wanted to buy some stocks in a small company (in New York USA). He is a stock broker and wanted to by the stocks ASAP but did not have a USA trading account so he gave my money and his own £25,000 to his close friend thus in total giving this friend £35,000.
Any how I asked for my money back, thus promoting my brother to ask his friend to sell the shares. The friend kept thobbing him off with excuses about why the shares could not be sold until one evening about a month ago two other friends of my brothers phoned and told my brother that they had also given this guy money and not received it back after a number of requests.
Some research was conducted into this guy and it transpired that he has a very big gambling problem. We also now suspect that no shares were every purchased and in fact, that the money has been used to pay off gambling debts.
My brother has tape recorded all his conversations of late with this guy in which he is heard to fully admit how much money of ours he has along with what purpose it was to be used for.
There is also a paper trail for all the money that exchanged hands.
We have approached the police who have advised us that this is a civil matter and that we should consult a solicitor (£££).
At present we do not have the funds to finance a civil case and were wondering, does anyone have any suggestions as to how we should proceed?
P.s my brother knows were this guy lives (the guy owns a very expensive house in Chigwell)

You need a lawyer
If you win the guy from chigwill would pay your legal fees.
I can't see how it would be a criminal case, as you leant him the money as a business deal, hence its a civil case.0 -

Unfortunaetly the courts would award him a big fat compensation cheque and he would have twice as much money to gamble with ..... :rolleyes:0
